Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your use of myCPD ("the Service"), a web-based continuing professional development tracking application operated by Soni Tek Solutions Inc. ("we", "us", "our"), a corporation registered in Ontario, Canada. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
2. Description of Service
myCPD is a personal record-keeping tool that helps healthcare professionals track their Continuing Professional Development (CPD) activities. The Service allows you to: - Log CPD activities and hours by regulatory category - View progress on a dashboard - Export activity logs as PDF and Excel reports (Pro feature) - Upload supporting evidence documents (Pro feature)
3. Not Affiliated With Regulatory Bodies
myCPD is NOT affiliated with, endorsed by, or operated by the College of Psychologists and Behaviour Analysts of Ontario (CPBAO), the Behavior Analyst Certification Board (BACB), or any other regulatory body. The Service is an independent personal record-keeping tool. Registrants are solely responsible for meeting their regulatory obligations and verifying the accuracy of their records.
4. Account Responsibilities
You are responsible for: - Providing accurate information during registration - Maintaining the security of your account credentials - All activity that occurs under your account - The accuracy and completeness of your CPD records You must be at least 18 years of age to use the Service.
5. Acceptable Use
You agree not to: - Use the Service for any unlawful purpose - Submit false or misleading information - Attempt to access other users' data - Interfere with the operation of the Service - Reverse engineer or attempt to extract source code
6. Data Ownership
Your data belongs to you. You retain all ownership rights to the CPD activity records, evidence documents, and other content you create or upload to the Service. We do not claim ownership of your content.
7. Subscription and Billing
Free Tier: Available at no cost with limited features as described on our pricing page. Pro Tier: Available for $9 CAD per month or $99 CAD per year. Payment is processed securely through Stripe. Subscriptions auto-renew unless cancelled. You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period. Prices are in Canadian Dollars (CAD) and may be subject to applicable taxes. We reserve the right to change pricing with 30 days' written notice to existing subscribers.
8. Refund Policy
We offer a full refund within 14 days of your initial Pro subscription purchase if you are not satisfied with the Service. After 14 days, no refunds are provided for the current billing period, but you may cancel to prevent future charges. To request a refund, contact support@soniteksolutions.ca.
9. Data Storage and Security
Your data is stored in Canada (AWS ca-central-1 region) using Supabase, an open-source backend platform. Data is encrypted in transit using TLS and encrypted at rest. Row-level security ensures that only you can access your data. While we implement industry-standard security measures, no system is completely secure. We cannot guarantee absolute security of your data.
10. Data Retention and Deletion
Your data is retained for as long as your account is active. If you delete your account, your data will be permanently removed from our systems within 30 days. We recommend exporting your data before deleting your account. CPBAO requires registrants to retain CPD records for a minimum of 5 years. It is your responsibility to maintain your own records in compliance with regulatory requirements.
11. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service downtime.
12. Limitation of Liability
To the maximum extent permitted by law, Soni Tek Solutions Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or missed regulatory deadlines, arising from your use of the Service. Our total liability for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
13. Disclaimer
The Service is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. myCPD does not provide professional, legal, or regulatory advice. The Service is a record-keeping tool only. You are solely responsible for ensuring your CPD activities meet the requirements of your regulatory body.
14. Modifications to Terms
We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Termination
We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through the Settings page. Upon termination, your right to use the Service ceases immediately.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
